Welcome to Practical Hosting, a hosting company dedicated to providing reliable and secure hosting services. These Terms of Service (“Agreement”) govern your use of our hosting services (“Services”), and your relationship with Practical Hosting. By using our Services, you agree to abide by these terms and conditions.
[1] Service Availablility
We will use commercially reasonable efforts to provide the Services 24 hours a day, seven days a week. However, we cannot guarantee uninterrupted access to the Services or that the Services will be error-free. We reserve the right to modify, suspend, or discontinue the Services at any time without notice.
[2] Account Registration
You must register for an account to use our Services. You agree to provide accurate and complete registration information and to promptly update your registration information as necessary. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
[3] Payment
You are solely responsible for making sure outstanding invoices are paid on time. In the event an invoice is overdue, we reserve the right to terminate your service at any point which will result in a loss of all data from your service.
[4] Content
You are solely responsible for the content of your website and any data that you upload to our servers. You agree not to use the Services to host or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable. We reserve the right to terminate any services that violate this Agreement
[5] Security
We will use commercially reasonable efforts to maintain the security of our systems and servers. However, you acknowledge that no system can be completely secure, and we cannot guarantee the security of our systems or servers. You are responsible for implementing appropriate security measures to protect your service(s) and data.
[6] Backups
We don't take any backups on behalf of clients for their servers. You are solely responsible for backing up your service(s) and any data.
[7] Support
We will provide technical support for the Services during our business hours. Our support is limited to the Services we provide and does not include assistance with server / project development, third-party software, or other non-service-related service issues.
[8] Disclaimer of Warranties
The Service(s) are provided “as is” and without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
[9] Limitation Of Liability
In no event shall Vortixia Holdings Limited be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the Service(s), including, but not limited to, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses.
[10] Indemnification
You agree to indemnify and hold harmless Vortixia Holdings Limited and its affiliates, officers, directors, employees, and agents from and against any claims, actions, demands, liabilities, expenses, or damages arising out of or in connection with your use of the Service(s), or your breach of this Agreement.
[11] Termination
The Client can request cancellation at any time through the billing site by either choosing Immediate cancellation or End Of Billing Cancellation. In the event of an immediate cancellation the services will be cancelled at the next available opportunity and all invoices associated to that service will be cancelled. If end of billing is selected Vortixia Holdings Limited will continue to provide the service until the due date provided in which it will be cancelled with all associated invoices. On termination all server files / data is deleted and not recoverable. If the client submits a cancellation request and would like to change their mind they can put in a ticket in their client area and request this, though there is no guarantee the cancellation request will be removed. Once a cancellation is requested, whether it's an Immediate cancellation or an End Of Billing period cancellation, credit / refunds are not offered for the current billing period. If the wrong cancellation is requested it is the clients responsibility to inform Vortixia Holdings Limited via a support ticket in the billing area.
[12] Governing Law
This Agreement shall be governed by and construed in accordance with respective laws, without regard to conflict of laws principles. Any legal action or proceeding arising out of or in connection with this Agreement shall be brought in the county court located in the UK, and each party irrevocably submits to the jurisdiction and venue of such courts.
[13] Assignement
You may not assign this Agreement without our prior written consent. We may assign this Agreement without your consent to any affiliate or successor in interest.
[14] Entire Agreement
This Agreement constitutes the entire agreement between you and Practical Hosting with respect to the Services and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Practical Hosting.
[15] Modifications
We reserve the right to modify this Agreement at any time without notice. Any changes to this Agreement will be posted on our website. Your continued use of the Services following any such modifications constitutes your acceptance of the revised Agreement.
[16] Waiver
The failure of either party to enforce any provision of this Agreement shall not be deemed a waiver of such provision or any other provision of this Agreement.
[17] Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to this Agreement, you may not use our Services.
[18] Refund Policy
A. We offer a no refund policy by default. Refunds may be requested, and it is at the discretion of Vortixia Holdings Limited staff though this is not guaranteed. Refunds are only applicable if a service has not been deployed 48 hours after deployment if stated as an Instant deployment package.
B. Dedicated servers have no refunds whatsoever.
C. Any chargebacks without the consent of Vortixia Holdings Limited will result in an immediate termination of service(s) with no refund.
D. There are no refunds for pre-orders. As soon as the server is deployed the 30 day period starts. You are still however able to request a standard cancellation for immediate / end of billing period as per our stand Terms and Conditions. If have signed up to a pre-paid commitment on a pre-order you only will be able to cancel for the end of your commitment.
[19] Eligibility To Use
Practical Hosting cannot allow the following users and viewers to use the platform in the following events:
A. You are not able to form legally binding contracts;
B. A person barred from receiving and rendering services under the laws of the United Kingdom or another applicable jurisdiction;
C. Are suspended from using the Service(s); or do not hold any valid form of communication between you and the services(s)
D. Your details are flagged by our Anti-Fraud system as carrying a high risk.
We may, at our absolute discretion, refuse to register any person or entity as a User. You cannot transfer or assign any rights or obligations you have under this agreement without prior written consent.
We have the right to deny you a service at any point for a breach of any of these agreements, these will not be held by any refund or SLA policies. If none of these are breached Vortixia Holdings Limited has the right to deny you a service at the end of the billing period
[20] Supply Of Services
1. We agree to supply the services to you in accordance with this policy, the product and or service description, affiliated description and the applicable pricing in full thereof.
2. We will use any and all reasonable efforts to supply the service to you once the purchase confirmation has been given and the payment has been successfully made, where we do become aware of a delay, we shall inform you promptly.
3. We shall not be liable to you for any damages in the event the services are not set up within the specified timeframe, thus it is expressed we shall not be applicable for any loss revenue, additional expenses relating to the delay and or any disputes and further damages relating to the delay.
4. The services shall be billable and or applicable on a month-to-month basis consisting of 30 calendar days, for some services it is applicable to a quarterly billable or applicable time, and or annual billable or applicable time.
5. We can attempt to collect an invoice for any amount of time using cards stored on your account to collect funds owed. This will be done by remote charging of your card in cases of no payment.

Terminated accounts information is deleted. Suspension of accounts does not regulate the termination of account data collection. If we decide to sell, buy, merge or otherwise reorganise our businesses in certain countries, this may involve us disclosing personal data to prospective or actual purchasers and their advisers, or receiving personal data from sellers and their advisers.

This SLA is a binding agreement between Practical Hosting, hereafter referred to as "Service Provider" and the client, hereafter referred to as "Client", for the provision of services as described in the following sections. The purpose of this SLA is to define the level of service and support that Service Provider will provide to the Client.
[1] Service Availability
Service Provider will use reasonable efforts to ensure that the services are available to the Client at all times. Service Provider will monitor the services and will take all necessary steps to correct any issues that may affect the service. The Client agrees that Service Provider may measure service availability via internal support and monitoring systems.
[2] Service Downtime
Service Downtime is any unplanned interruption in Service Availability during which the Client is unable to access the services as described in the preceding section, provided the interruption is determined to have been caused by a problem in the immediate Service Provider services and/or network segment. Downtime is measured as the total length of time of the unplanned interruption in Service Availability during a calendar month.
[3] Service Level Agreement Credit
If the Client experiences downtime due to a problem with Service Provider services and/or network segment as confirmed by Service Provider, the Client may claim SLA Credit by opening a billing ticket. Service level agreement credit occurs after a service has been unreachable for more than 1 hour. For each hour of downtime the client will be credited 6 hours of the affected services'.
Service Level Agreement Exclusions :
The following events will not be covered by the Service Level Agreement.
A. Acts of God; in the event downtime is suffered due to extreme weather at data centres and/or any other means defined by legislation will not be covered.
B. Any unlawful activities against the client and/or caused by the client; such as DDOS attacks, server illegal activities and terminations.
C.And/or exceeding resources allocated by the Client's plan.
D. Dedicated servers are covered by a 1:1 downtime, for each 1 hour down you will receive 1 hour worth of credit added onto your account.
E. SLA not available for announced downtime / maintenance. You will be given a fair warning in the email registered to your account and or in a discord channel.
F. If Service Provider believes the SLA claim to be fraudulent
[4] Support Services
Service Provider will provide support related to services to the Client via email, phone, or chat. The support services will be available on a best endeavours basis excluding national holidays.
[5] Service Fees
The Client agrees to pay the fees for the services as described in the Service Agreement. Service Provider reserves the right to change the fees at any time and will make all reasonable efforts to inform the Client giving as much notice as possible.
[6] Service Agreement Termination
Either party may terminate this Service Agreement upon providing 30 days' notice to the other party. In the event of early termination by the Client, the Client shall pay Service Provider all fees due up to the termination date.
[7] Limitation of Liability
Service Provider's total liability to the Client for any damages arising out of or related to this Service Agreement, whether in contract or tort, shall be limited to the fees paid by the Client to Service Provider for the services during the one (1) month period preceding the event giving rise to the liability.
[8] Governing Law
This Service Agreement shall be governed by and construed in accordance with the laws of the state/province/country in which Service Provider is located, and any dispute arising out of or related to this Service Agreement shall be subject to the exclusive jurisdiction of the courts located in that state/province/country.
[9] Entire Agreement
This Service Agreement constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreements, understandings, and negotiations, whether oral or written, between the parties with respect to the subject matter hereof. Any modifications or amendments to this Service Agreement must be in writing and signed by both parties.
[10] Assignment
No waiver of any provision of this Service Agreement shall be deemed a waiver of any other provision, nor shall any waiver constitute a continuing waiver. Failure to enforce any provision of this Service Agreement shall not be deemed a waiver of such provision or any other provision.
[11] Waiver
This Service Agreement may not be assigned by either party without the prior written consent of the other party. However, Service Provider may assign this Service Agreement without the consent of the Client to any entity that acquires all or substantially all of the assets of Service Provider or to any successor in interest by merger or consolidation.
[12] Severability
If any provision of this Service Agreement is held to be invalid, illegal, or unenforceable, such provision shall be severed from this Service Agreement and the remaining provisions shall remain in full force and effect.
[13] Notices
Any notices required or permitted under this Service Level Agreement shall be in writing and shall be delivered to the parties at the addresses specified in this service.
[14] Notices
Agreement or at such other addresses as the parties may designate in writing. Notice may be given by personal delivery, registered or certified mail, or by email.
[15] Headings
The headings used in this Service Agreement are for convenience only and shall not affect the interpretation of this Service Agreement.

By using our services, you agree to comply with this AUP, as well as our Terms of Service and Privacy Policy.
[1] Lawful Content
You may only use Practical Hosting's services for lawful purposes. You shall not host, transfer, distribute, or store any material on or through our services that violates any applicable law or regulation, including but not limited to material that is protected by copyright, trademark, or any other intellectual property rights, illegal or defamatory material, and any content that could be considered unlawful.
[2] Network Usage
We have complete control over our network infrastructure, and we are responsible for ensuring the security and integrity of our systems. You are prohibited from using our network to obtain or disseminate any unlawful materials, including but not limited to stolen intellectual property, child pornography, and hate speech. The use of bandwidth-mining technologies for cryptocurrency and IPTV services is strictly prohibited on our network.
[3] System And Security
You are not allowed to circumvent user authentication or security measures or interfere with service to any user, host, or network. Any attempt to breach security or authentication measures without our express authorization is strictly prohibited. You are not allowed to forge any TCP-IP packet headers or use our services for spoofing. Hosting public VPNs or proxy services via our systems is also not permitted. The use of our systems to provide DDoS protection for services with other providers is strictly prohibited.
[4] Hardware
The use of our machines for cryptocurrency mining or any other cryptocurrency gain is strictly prohibited. The use of our services for ecommerce bots is also not permitted. You are not allowed to overclock or tweak performance settings on our machines without our explicit prior consent.
[5] Fair Access
To ensure that all users have fair and equal access to our services and to protect the integrity of our network, we reserve the right to take necessary steps to prevent improper or excessive usage. This may include limiting throughput, preventing or limiting service through specific ports and/or communication protocols, or terminating service to users who grossly abuse the network through improper or excessive usage. Excessive usage is defined via an internal policy and varies wildly. The policy applies to and will be enforced for intended and unintended prohibited usage. Your online activity will be subject to the available bandwidth, data storage, and other limitations of the service provided, which we may revise at our discretion without prior notice. We take the proper usage of our services seriously and will take necessary action to enforce this policy. Failure to comply with this AUP may result in suspension or termination of your account without notice.
